Terms & Conditions

These terms govern your access to and use of OriginAtlas. Please read them carefully — by creating an account you agree to be bound by them.

1. Who we are

OriginAtlas (“OriginAtlas,” “we,” “us,” or “the Platform”) is a software-as-a-service platform that lets travel agents build a branded online store, list tour packages, activities, stays and transfers, offer a distance-based trip-cost estimator, and collect payments into their own payment account. These Terms & Conditions (“Terms”) form a legal agreement between OriginAtlas and you.

2. Definitions

  • Merchant (“you”) — the travel agent or business that registers for an account and operates one or more Stores on the Platform.
  • Store — a storefront you publish on a Platform subdomain (for example yourbrand.originatlas.shop) or a connected custom domain.
  • Customer — an end user who visits your Store and books or enquires about your travel products. Customers are your customers, not ours.
  • Content — any text, images, itineraries, pricing, rate cards, branding and other material you upload or publish through the Platform.

3. Eligibility & your account

You must be at least 18 years old and able to enter into a binding contract to use OriginAtlas. You agree to provide accurate account information and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at support@originatlas.shop if you suspect any unauthorised use.

4. What the Platform provides

OriginAtlas provides the software and hosting for you to run your travel store. This includes storefront themes, product and vehicle management, a trip-cost estimator, lead capture, SEO tooling, custom-domain connection and the integrations described in these Terms. We provide the tools; you are solely responsible for the travel products, services, prices, itineraries and bookings you offer and fulfil through your Store.

5. Subscription, fees & billing

Access to the Platform is provided on a recurring subscription basis for a flat platform fee per billing period, as shown on our pricing page at the time you subscribe. This fee is what you pay us to use the Platform.

  • No commission on bookings. We do not take a per-order or per-booking cut. One hundred percent of what your Customers pay for a booking is settled to your own payment account (see Section 6).
  • Manual renewal. Each billing period is renewed by you paying the platform fee for that period. We do not operate an automatic auto-debit mandate; if the fee for a period is not paid, your Store may be suspended until payment is made.
  • Taxes. Fees are exclusive of any applicable taxes, which will be added where required by law.
  • No refunds. Except where required by applicable law, platform subscription fees are non-refundable, including for partial billing periods.

6. Payments & your payment provider

Customer payments on your Store are processed through your own Razorpay account, using API keys you connect on your dashboard. This means:

  • Funds from bookings flow directly to your Razorpay account. OriginAtlas does not hold, receive, escrow or route your Customers’ booking payments, and is not a payment processor, payment aggregator or money-services business.
  • Your use of Razorpay is governed by Razorpay’s own terms and policies. You are responsible for maintaining your Razorpay account in good standing, completing its KYC and onboarding, and complying with its rules.
  • You are responsible for the tax treatment of your sales (including GST invoicing where applicable), for honouring the bookings you accept, and for any refunds, cancellations, chargebacks or disputes with your Customers.
  • The keys and secrets you provide are stored encrypted at rest and are used only to enable checkout and payment verification on your own Store.

Any contract of sale for a travel product is solely between you and your Customer. OriginAtlas is not a party to that contract and is not a travel agent, tour operator or seller of travel.

7. Your responsibilities as a Merchant

  • List products, prices, availability and itineraries accurately and keep them current.
  • Hold any licences, registrations or permits required to sell travel services in your jurisdiction, and comply with all applicable travel, consumer-protection and tax laws.
  • Fulfil bookings you accept and handle Customer service, complaints and refunds.
  • Provide your Customers with your own terms of sale, cancellation policy and privacy notice as required by law.
  • Ensure your Content and use of the Platform comply with Section 8.

8. Acceptable use

You agree not to use the Platform to:

  • break any law, or facilitate fraud, money laundering or deceptive practices;
  • publish content that infringes intellectual-property rights, is defamatory, obscene or unlawful, or that you do not have the right to use;
  • upload malware, attempt to gain unauthorised access to the Platform or other tenants’ data, or disrupt, overload or reverse-engineer the service;
  • resell, sublicense or white-label the Platform itself without our written consent.

9. Intellectual property

The Platform, its software, design, themes and trademarks remain the property of OriginAtlas. You retain ownership of your Content. By publishing Content through the Platform, you grant us a non-exclusive, worldwide licence to host, store, reproduce and display that Content solely for the purpose of operating and providing the service to you and your Customers.

10. Custom domains & third-party services

You may connect a custom domain to your Store. You are responsible for owning that domain and for the accuracy of its DNS configuration. The Platform relies on third-party services to operate — including payment processing (Razorpay), hosting and infrastructure, mapping and geocoding providers used by the estimator, and optional AI features. Your use of features that depend on those services is also subject to their respective terms, and we are not responsible for their availability or acts.

11. Availability & “as is” service

We work to keep the Platform available and secure, but the service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including fitness for a particular purpose and uninterrupted or error-free operation. We may modify, suspend or discontinue features, and may perform maintenance that temporarily affects availability.

12. Limitation of liability

To the maximum extent permitted by law, OriginAtlas will not be liable for any indirect, incidental, special, consequential or exemplary damages, or for any loss of profits, revenue, data, bookings or goodwill, arising out of or relating to your use of the Platform. Our total aggregate liability for any claim relating to the Platform will not exceed the total platform fees you paid to us in the twelve months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to indemnify and hold harmless OriginAtlas from any claims, damages, liabilities and expenses arising out of your Content, your travel products and bookings, your dealings with Customers, your breach of these Terms, or your violation of any law or third-party right.

14. Suspension & termination

You may stop using the Platform and close your account at any time. We may suspend or terminate your account or a Store if you breach these Terms, fail to pay platform fees, or use the Platform in a way that harms Customers, other Merchants or the Platform. On termination, your right to use the Platform ends; provisions that by their nature should survive (including Sections 6, 9, 12 and 13) will survive.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

16. Governing law

These Terms are governed by the laws of India, and you agree to the exclusive jurisdiction of the competent courts in India for any dispute arising out of or in connection with them, without regard to conflict-of-laws principles.
